The Texas Data Privacy and Security Act (TDPSA) is a pioneering law that governs data protection for residents and businesses in Texas. It regulates all forms of personal data processing, including collection, use, storage, sharing, transfer, and updating, to safeguard individuals' rights over their personal data. The TDPSA came into full effect on July 1, 2024.
TDPSA applies to any entity that conducts business in Texas or produces products or services consumed by Texas residents. Unlike other laws, it does not have revenue thresholds. The law also excludes small businesses as defined by the U.S. Small Business Administration.
Under the TDPSA, Texas residents have rights to access, correct, delete, and obtain copies of their personal data. They can also opt-out of the sale of their data and targeted advertising. Consent for processing sensitive data must be freely given, specific, and informed.
The Texas Attorney General enforces the TDPSA. Non-compliant entities face fines of up to $7,500 per violation. Businesses have a 30-day period to cure violations after being notified by the Attorney General.
