The Florida Digital Bill of Rights (FDBR) is a privacy law enacted to protect the personal data of Florida residents. It governs how businesses handle personal data, ensuring individuals' rights over their information. The FDBR came into full effect on July 1, 2024.
FDBR applies to any business operating in Florida or offering products and services to Florida residents, particularly those with annual revenues over $1 billion. There are exemptions for government entities, nonprofits, higher education institutions, and financial institutions subject to other federal laws.
Floridians have the right to access, correct, delete, and obtain copies of their personal data under the FDBR. They can also opt out of the sale of their data and targeted advertising. Businesses must obtain explicit consent before processing sensitive data.
Non-compliance with the FDBR can result in fines up to $50,000 per violation, which can triple for violations involving minors. The Florida Attorney General enforces the law, and businesses may have a cure period to address violations.
