The Colorado Privacy Act (CPA) is a comprehensive privacy law designed to protect the personal data of Colorado residents. It establishes rights for consumers over their personal data and sets obligations for businesses on how they handle this data. The CPA came into effect on July 1, 2023.
The CPA applies to businesses that collect personal data from at least 100,000 Colorado residents annually, or from 25,000 residents while deriving revenue from selling that data. Exemptions include data covered by federal laws such as HIPAA and entities like air carriers and higher education institutions.
Under the CPA, consumers have the right to access, correct, delete, and obtain copies of their personal data. They can also opt out of the sale of their data, targeted advertising, and profiling. Consent is required for processing sensitive data, which includes information like racial or ethnic origin and health data.
Non-compliance with the CPA can result in penalties of up to $20,000 per violation, enforced by the Colorado Attorney General's office. Businesses have a 60-day cure period to address violations before penalties are applied.
